These Terms of Sale (“Terms”) govern the purchase of products and services from Joys Boutique (“we”, “our”, “us”) through our website, social media platforms, in-store consultations, or any other sales channels operated by Joys Boutique. By placing an order, you agree to be legally bound by these Terms.
1. About Joys Boutique
Joys Boutique is a fashion and design studio specializing in customized and ready-to-wear garments, including but not limited to wedding gowns, bridal wear, communion gowns, baptism dresses, bridesmaid dresses, flower girl dresses, party wear, and coordinated family outfits.
All products are crafted with attention to detail and may involve manual tailoring, embellishment, and customization.
We offer the following categories:
- Custom-made garments
- Made-to-measure outfits
- Semi-customized designs
- Ready-to-wear collections
- Design consultations and fittings
- Alteration services (where applicable)
Product images, sketches, and descriptions are provided for reference only. Minor variations in color, fabric texture, embroidery, or finishing may occur due to the handcrafted nature of our products.
3.1 Order Confirmation
An order is considered confirmed only after:
- Final design approval (for customized orders), and
- Receipt of the required advance payment.
Order confirmation may be communicated via email, WhatsApp, invoice, or written acknowledgment.
3.2 Accuracy of Information
Customers are responsible for providing accurate:
- Measurements
- Design approvals
- Fabric and color selections
- Delivery details
Joys Boutique shall not be liable for errors resulting from incorrect information provided by the customer.
4. Customization & Measurements
4.1 Custom Orders
Custom-made garments are produced based on individual preferences, measurements, and approvals. Once production has commenced, no changes or cancellations will be permitted.
Measurements may be:
- Provided by the customer, or
- Taken by Joys Boutique during in-person fittings.
We strongly recommend in-person measurement sessions for best fit. Joys Boutique is not responsible for fitting issues arising from self-submitted measurements.
5. Pricing & Taxes
- All prices are displayed in Indian Rupees (INR) unless stated otherwise.
- Prices are subject to change without prior notice until an order is confirmed.
- Applicable taxes (including GST) will be charged as per prevailing government regulations.
- Custom designs, premium fabrics, embellishments, and urgent delivery may incur additional charges.
6.1 Advance Payment
- A non-refundable advance payment is mandatory to initiate any order.
- The advance amount will be communicated at the time of order confirmation.
6.2 Balance Payment
- The remaining balance must be paid before dispatch or delivery.
- Failure to complete payment may result in order delay or cancellation without refund.
6.3 Payment Methods
We accept payments via:
- Bank transfer
- UPI
- Cash (in-store only)
7. Production Timeline
Estimated delivery timelines are shared at the time of order placement. These are indicative timelines only and may vary due to:
- Design complexity
- Fabric availability
- Alteration requirements
- Force majeure events
Joys Boutique shall not be liable for delays caused by circumstances beyond reasonable control.
8. Alterations & Fittings
- One or more fittings may be required depending on the garment type.
- Minor alterations are generally included unless otherwise specified.
- Additional alterations due to significant measurement changes may attract extra charges.
Alterations requested after final delivery may not be accommodated.
9. Shipping, Delivery & Pickup
9.1 Delivery Options
- In-store pickup
- Domestic courier shipping
- International shipping (subject to availability)
Shipping charges, if applicable, will be communicated separately.
9.2 Risk & Responsibility
- Once dispatched, the risk of loss or damage passes to the customer.
- Joys Boutique is not responsible for courier delays, customs clearance delays, or damage during transit.
10. Cancellations, Returns & Refunds
10.1 Cancellations
- Orders cannot be cancelled once production has commenced.
- Advance payments are strictly non-refundable.
10.2 Returns & Exchanges
Due to the customized and made-to-order nature of our products:
- Returns, exchanges, or refunds are not permitted.
- Ready-to-wear items may be eligible for exchange only if explicitly stated at the time of purchase.
10.3 Defects
In the unlikely event of a manufacturing defect, customers must notify Joys Boutique within 48 hours of delivery, along with photographic evidence.
11. Intellectual Property
All designs, images, sketches, content, and branding displayed on the Joys Boutique website and platforms are the exclusive intellectual property of Joys Boutique.
Unauthorized copying, reproduction, or commercial use is strictly prohibited.
12. Limitation of Liability
Joys Boutique shall not be liable for:
- Minor variations in design or color
- Delays due to external factors
- Indirect or consequential damages
Our maximum liability, under any circumstances, shall not exceed the total amount paid by the customer for the order.
13. Force Majeure
We shall not be held responsible for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, supply chain disruptions, or government restrictions.
14. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts located in Pune- Maharashtra, India.
15. Amendments
Joys Boutique reserves the right to modify or update these Terms of Sale at any time without prior notice. The latest version will always be available on our website.
